Presiden: UU Cipta Kerja Tak Mengurangi Kewenangan Daerah
JAKARTA, jurnaljateng.id, Presiden Joko Widodo menegaskan bahwa Undang-Undang (UU) Cipta Kerja tidak menjadikan pemerintah melakukan resentralisasi kewenangan dari pemerintah daerah ke pemerintah pusat. Menurutnya, perizinan berusaha dan pengawasannya tetap dilakukan oleh pemerintah daerah sesuai dengan norma, standar, prosedur dan kriteria yang ditetapkan pemerintah pusat.
Demikian disampaikan Presiden Joko Widodo saat memberikan keterangan pers terkait Undang-Undang Cipta Kerja di Istana Kepresidenan Bogor, Jawa Barat, pada Jumat, 9 Oktober 2020.
“Perizinan berusaha dan pengawasannya tetap dilakukan oleh Pemerintah Daerah sesuai dengan NSPK (Norma, Standar, Prosedur, Kriteria) yang ditetapkan Pemerintah Pusat, ini agar dapat tercipta standar pelayanan yang baik di seluruh daerah, dan penetapan NSPK ini nanti akan diatur dalam PP (Peraturan Pemerintah),” kata Presiden.
Selain itu, Presiden juga menjelaskan bahwa kewenangan perizinan untuk nonperizinan berusaha tetap ada di Pemda, sehingga tidak ada perubahan. Bahkan, melalui UU Cipta Kerja pemerintah juga melakukan penyederhanaan, standarisasi jenis, prosedur berusaha di daerah, dan perizinan berusaha di daerah diberikan batas waktu.
“Ini yang penting di sini. Jadi, ada service level of agreement, permohonan perizinan dianggap disetujui bila batas waktu telah terlewati,” imbuhnya.
Kepala Negara juga menegaskan bahwa Undang-Undang Cipta Kerja ini memerlukan banyak sekali Peraturan Pemerintah (PP) dan Perpres (Peraturan Presiden). Menurut Presiden, PP dan Perpres tersebut akan segera diselesaikan paling lambat tiga bulan setelah diundangkan.
“Kita, pemerintah membuka dan mengundang masukan dari masyarakat, dan masih terbuka usulan-usulan dan masukan dari daerah,” ungkapnya.
Pemerintah berkeyakinan melalui Undang-undang Cipta Kerja ini jutaan pekerja dapat memperbaiki kehidupannya dan juga penghidupan keluarga mereka. Jika masih ada ketidakpuasan atas Undang-Undang Cipta Kerja ini, Presiden mendorong agar hal tersebut diselesaikan melalui Mahkamah Konstitusi (MK).
“Jika masih ada ketidakpuasan terhadap Undang-Undang Cipta Kerja ini, silakan mengajukan uji materi atau judicial review melalui Mahkamah Konstitusi. Sistem ketatanegaraan kita memang mengatakan itu. Jadi, kalau masih ada yang tidak puas dan menolak, silakan diajukan uji materi ke MK,” tandasnya.
