Perkara YIC Sudirman Ambarawa Jadi Sorotan Publik, LBH ICI Jateng Sebut Murni Pidana
JURNALJATENG ID. UNGARAN – Terkait perkara pembuatan perubahan akta notaris Yayasan Islamic Centre Sudirman Ambarawa, yang saat ini dalam proses persidangan di Pengadilan Negeri Ungaran adalah murni kasus pidana.
Demikian ditandaskan Imam Supriyono SH MH, Tim Advokat LBH ICI Jateng, selaku kuasa hukum dari H Mohammad Amin Sjamsuri BA, dan tiga ahli waris pendiri YIC Sudirman Ambarawa, saat dikonfirmasi awak media, Kamis, (20/1/2022).
Dijelaskan Imam, awalnya kasus tersebut diadukan ke Polda Jateng, pada tahun 2018 lalu, terkait dugaan Tindak Pidana Pasal 264 ayat (1) jo Pasal 266 ayat (1) KUHPidana, terkait dengan dugaan tindakan pidana yang dilakukan oleh Ny SF dan Notaris TFR SH MKn, yang merugikan, khususnya pendiri Yayasan Islamic Centre Sudirman Ambarawa, terus berlanjut. Dugaan tindak pidana tersebut diantaranya terkait dengan perubahan akta notaris yayasan tersebut, yang sengaja dilakukan.
“Jadi dalam persoalan tersebut prosesnya panjang, hingga saat ini akhirnya Ny Siti Farida SH MH, telah ditetapkan sebagai terdakwa, dan saat ini perkara masih terus berjalan,” ungkap Imam.
Menanggapi Dr. Drs. Hono Sejati, S.H., M.Hum., selaku kuasa hukum Ny Siti Farida SH MH, menyampaikan kepada awak media, jika eksepsi itu ada wewenang mengadili, wewenang mengadili itu bisa saja, hakim bisa ke tum, bisa ke agama, bisa ke perdata, lalu yang lain pada eksepsi pada pokok perkara, Imam menandaskan jika ini pemalsuan jadi ini murni perkara pidana.
“Pemalsuan itu murni perkara pidana, bukan perdata, perlu dipahami itu. Kan perkaranya tidak masuk dalam perkara waris, ataupun perkara perkara lain, karena ini murni ada suatu penyimpangan terkait pemalsuan, sehingga tidak bisa diarahkan pada perkara perdata,” tandas Imam.
Dijelaskan Imam, harusnya eksepsi itu menyangkut pada pokok perkara, sehingga eksepsi itu nantinya akan dibuktikan dipersidangan.
“Dalam kasus ini kita melihat ini murni pidana. Namun jika pihak kuasa hukum Ny Siti Farida SH MH, berasumsi lain ya itu hak mereka. Kalau saya melihat pada pokok perkara saja,” jelasnya.
Sementara itu, Dr Arifin salah satu dari pihak penggugat menambahkan, yang perlu ditekankan ini bukan sengketa waris, tapi pemalsuan tanda tangan dengan maksud menguasai aset yayasan dan hingga saat ini terdakwa masih menguasai SHM yang notabene adalah milik yayasan.
Terpisah sejumlah tokoh agama yang enggan disebutkan namanya, berharap persoalan sengketa Yayasan Islamic Centre Sudirman Ambarawa, segera berakhir dan ada ketetapan hukum.
“Semoga lekas terang benderang, dan berharap bapak atau ibu hakim jangan masuk angin, dan jalankan tugas menggunakan hati. Dan dari sudut pandang kami itu kasus pidana, jangan dikaburkan nantinya. Prinsipnya kami sebagai masyarakat percayakan penuh kepada bapak ataupun ibu hakim dan penegak hukum terkait,”ucapnya sembari, serukan kebenaran harus ditegakan.
Diberitakan sebelumnya, Dr. Drs. Hono Sejati, S.H., M.Hum., dan rekan kuasa hukum SF, saat dikonfirmasi awak media, usai sidang di Pengadilan Negeri Ungaran mengungkapkan, Eksepsi itu ada wewenang mengadili, wewenang mengadili itu bisa saja, hakim bisa ke tum, bisa ke agama, bisa ke perdata, lalu yang lain pada eksepsi pada pokok perkara.
Dijelaskan Dr. Drs. Hono, namun mengenai kompetensi disebutnya harus ada keputusan.
”Tapi alhamdulillah sebelum membahas itu, kita mengajukan pengalihan tahanan rumah dan alhamdulillah di kabulkan, juga saat ini langsung bisa pulang. Ini tinggal menunggu penetapan dari adminitrasi saja,” pungkasnya.
