Narendra, DPRD Kota Semarang Siap Mediasi Masalah Banjir Di Puri Anjasmoro
JURNALJATENG.ID, SEMARANG – Warga Puri Anjosmoro adukan penanganan banjir ke Komisi A DPRD Kota Semarang yang tak kunjung selesai. Benedikus Narendra Keswara, Anggota DPRD Kota Semarang siap menerima pengaduan warga Puri Anjasmoro melalui Paguyuban Bantaran Sungai Tawangsari (PBST).
Ia berharap, warga Puri Anjasmoro yang mengadukan penanganan banjir oleh PT IPU tetap sesuai jalur, harus memakai aturan. Harus di bedah dengan aturan hukum yang berlaku, agar nantinya tiak ada pelanggaran hukum.
“Dikomisi A nanti akan membedah dan menelaah secara hukum dan peraturan yang berlaku. ini kami sudah menerima surat aduannya dari warga Puri Anjasmoro dan Paguyuban Bantaran Sungai Tawangsari yang akan kami tindak lanjuti aduanya” ungkap anggota Komisi A DPRD Kota Semarang, Jumat (16/4/2021).
Narendra mengatakan akan mengkaji aduan Warga Puri Anjasmoro dengan di dasari dan berlandaskan hukum, sesui dengan Perda. Mulai dari yang dilakukan pengembang hingga pengambil alihan penanganan banjir dari PT IPU ke pemerintah Kota Semarang sudah ada aturanya yang jelas.
“Melihat adanya keluhan yang disampaikan oleh warga Puri melalui perwakilan kelompok yang tergabung dalam PBST, kami langsung lakukan tinjauan ke lapangan dan berhasil menghimpun beberapa keterangan yang pada pokoknya menyatakan adanya kendala dari Pengembang.” Ungkapnya.
Serah terima aset kepada Pemkot, lanjutnya belum terlaksana dengan baik, sehingga menyebabkan Pemkot belum bisa melakukan intervensi atau maintenance terhadap tata kelola lingkungan yang baik. Khususnya dalam penyelesaian persoalan banjir yang beberapa hari lalu menerjang Kawasan tersebut.
Pokok permasalahan yang coba di petakan, antara pihak pengembang dengan Pemerintah Kota Semarang ada yang belum tercapai atau terlaksana. Terdapat pengelolaan Prasarana, Sarana dan Utilitas (PSU) yang belum diserahkan kepada Pemkot sehingga Pemkot belum atau tidak bisa ambil bagian dalam pengelolaan lingkungan yang terdapat pada Kawasan tersebut.
“Padahal tujuan dari penyerahan PSU tersebut semata-mata untuk menjamin keberlanjutan pemeliharaan dan pengelolaan PSU dilingkungan perumahan dan permukiman melalui Anggaran yang dianggarkan dalam Anggaran Pemerintah Daerah (APBD).” Jelasnya.
Dalam Pasal 11 ayat (2) Permendagri No 9 Tahun 2009 sudah mengatur mengenai limitative waktu dalam hal penyerahan PSU tersebut yakni pada pokoknya diberikan waktu paling lambat satu tahun setelah masa pemeliharaan dan sesuai dengan rencana tapak yang telah disetujui oleh Pemerintah Daerah. Rencana tapak tersebut dengan berpegang pada ayat (3) dpt dilakukan bertahap atau sekaligus.
“Jadi logika sederhananya pengembang sebelum mendirikan perumahan tersebut sudah ada komunikasi sampai dikeluarkannya ijin yang mengatur mengenai titik mana saja yang masuk menjadi PSU dan tenggang waktu penyerahan dari PSU,” ungkap Narendra.
Lebih lanjut Narendra berharap dinas terkait menindaklanjuti keluhan warga tersebut, karena kajian hukumnya pun juga sudah cukup jelas, mengatur sanksi baik secara administrasi maupun sanksi pidana sebagaimana diatur dalam Pasal 29 dan Pasal 31 Perda Kota Semarang No 6 Tahun 2015 tentang Penyediaan, Penyerahan dan Pengelolaan Prasarana, Sarana dan Utilitas Kawasan Perumahan, Kawasan Perdagangan dan Jasa serta Kawasan Industri.
“Aturan sudah jelas didalam perda tersebut. Memang harusnya itu kewajiban pengembang menyerahkan PSU kepada Pemerintah Kota. Kalau ini belum diserahkan ke pemerintah kota, pemerintah belum bisa menangani fasum -fasum yang masih dibawah bendera developer, yang kini PT IPU yang harus bertanggung jawab dan menjelaskan kepada kami,” Tegasnya.
Lebih jauh, ia meminta upaya ini berlanjut, agar pihak pengembang bisa diajak komunikasi, antara warga dengan pimpinan pengembang, pihaknya meminta warga agar berkirim surat klarifikasi ke DPRD Kota. Nantinya pihak dewan siap membantu mengadakan mediasi dengan pimpinan pengembang.
Bahkan ia akan memanggil pihak PT IPU untuk bisa memberikan jalan keluar yang terbaik bagi warga Puri Anjasmoro sehingga permasalahan banjir dapat terselesaikan dengan baik.
Bila hal tersebut tidak tercapai, Komisi A akan mengajak rembug bersama dengan intansi terkait. Walikota kota Semarang sebagai penegak perda harus berani mengambil alih kebijakan yang merugikan warga setempat.
“Dari mediasi itu bisa diketahui pengembang masih sanggup atau enggak. Kalau udah enggak sanggup serahkan ke Pemkot dengan beberapa persyaratan sesuai aturan yang ada,” pungkasnya
Untuk di ketahui Budi sulistyo selaku ketua Warga Puri Anjasmoro Semarang yang tergabung dalam PBST mengajukan surat permohonan kepada Komisi A DPRD kota Semarang untuk memfasilitasi pengaduanya kepada pemerintah, karena selama ini sudah bertemu dengan pengembang yang di fasilitasi pihak kelurahan setempat tidak ada jalan keluar. Dalam penangan banjir tersebut agar Pemkot bisa mengambilalih penanganan banjir. Warga merasa pihak pengembang tidak mengerjakan tugasnya secara maksimal.
