Dirut PT. IMSS Menakuti Penggugat Saat Usai Sidang Perdata
JURNALJATENG.ID, MADIUN – Direktur Utama PT. IMSS (Inka Multi Service Solusi), Kolik (tergugat), menyampaikan ungkapan bernada mengancam atau menakut nakuti, kepada Sunarto (penggugat) di ruang sidang Pengadilan Negeri Madiun Kota, Selasa (19/01).
Ungkapan tersebut disampaikan Kolik usai sidang lanjutan, dengan berjalan menyeberang dari tempat duduknya menghampiri bangku penggugat.
“Selesai sidang tadi, Pak Kolik menghampiri saya. Dia bilang, kalau diteruskan, sebenarnya kasihan sama saya. Katanya saya bisa dipenjara,” ungkap Sunarto kepada jurnalis, di luar ruang sidang.
Kecuali itu, di luar persidangan, dua pengacara yang mendampingi Kolik (tergugat), Joko, SH, dan Wahyu, SH, menawarkan barter perkara tersebut, dengan job pekerjaan baru kepada pengacara Sunarto (penggugat), Arifin, SH.
“Intinya pihak tergugat itu meminta kepada kita (penggugat) untuk mengakhiri (menutup/mencabut/membatalkan) persidangan ini, untuk kemudian akan diberikan pekerjaan proyek kembali oleh PT. IMSS,” ungkap Sunarto.
Namun, permintaan tersebut langsung ditolak oleh pihak tergugat. Alasan mendasarnya, berarti uang haknya yang sedang diperjuangkan di persidangan itu akan musnah. Kemudian, belum tentu juga proyek yang dijanjikan itu ada, dan diberikan kepadanya.
Permintaan konfirmasi jurnalis via whatsapp kepada Kolik, atas dugaan ucapan yang disampaikan kepada penggugatnya itu, belum dijawab. Humas PT. IMSS, Alvi, yang dimintai tolong jurnalis (via WA), untuk menyampaikan konfirmasi tertulis kepada Kolik, juga belum mendapat jawaban.
Sementara Humas BUMN PT. INKA (selaku induk perusahaan PT. IMSS), Bambang. R, yang diminta tolong menyampaikan konfirmasi, juga lewat WA, mengaku tidak berani menyampaikannya. “Maaf, saya tidak berani, ini sudah masuk persidangan, takutnya malah berkembang masalahnya,” tutur Bambang. R, secara tertulis.
Ditambahkannya, dia merasa berdosa jika ada dua pihak yang bertentangan, bukannya mendamaikan tetapi malah ngipas ngipasin. Yang dikhawatirkan perkara yang berawal perdata akan berubah menjadi pidana.
Sebelum palu dihantamkan hakim tunggal, Endratno Rajamai, SH, sebagai tanda tutup sidang beragenda penyerahan bukti tertulis itu, majelis hakim kembali menanyakan apakah kedua pihak yang bersengketa telah melakukan mediasi, sebagaimana dipesan hakim pada sidang perdana sebelumnya.
Kedua pihak, Sunarto (penggugat) dan Kolik (tergugat) sama sama menyatakan pihaknya belum pernah melakukan mediasi, guna mengurai persoalan secara damai.
“Saya hanya mengikuti keinginan mereka (penggugat) Pak Hakim,” ujar Kolik, ingkat menjawab hakim.
Mendengar itu, hakim tunggal, Endratno Rajamai, SH, menyambar keras, “loh pihak tergugat itu jangan malah pasif. Biasanya yang pasif itu adalah penggugat. Lha ini kok malah terbalik,” cetus Endratno Rajamai, SH, dengan culasnya.
Lebih lanjut sang hakim menyarankan kedua pihak membuka pintu perdamaian selebar mungkin. Disebutnya, perdamaian itu menaikkan derajat. Baik bagi penggugat, tergugat, maupun para pengacaranya.
Lebih lanjut hakim tunggal meminta kedua pihak menambah jumlah bukti, yang dirasa hakim masih kurang. Pelengkapan tersebut diminta hakim untuk diserahkan di sidang lanjutan, Kamis (21/01), dengan agenda bukti susulan plus pemeriksaan saksi.
Seperti diberitakan sebelumnya, Dirut PT. IMSS, Kolik, anak perusahaan plat merah itu digugat perdata tiga orang rekanan kerjanya, Sunarto, Sugito, dan Widodo, masing masing sebesar Rp. 500 juta .
Ketiga vendor ini menuntut pembayaran pekerjaaan proyek di lingkungan PT. INKA yang rampung dikerjakannya, namun hingga kini belum dibayar.
