Ini Perbedaan Aturan Upah UU ketenagakerjaan dengan UU Cipta Kerja
JAKARTA, jurnaljateng.id, Pengesahan Undang-Undang Cipta Kerja (UU Ciptaker) yang dilakukan Dewan perwakilan Rakyat Republik Indonesia (DPR RI), Senin (5/10/2020) lalu menjadi polemik serta penolakan dari berbagai elemen terutama bagi buruh dan pekerja karena di anggap merugikan Buruh.
Kini ketentuan upah bagi pekerja tengah menjadi sorotan. Dimana hal itu tertuang dalam UU Cipta Kerja yang sebelumnya sudah diatur dalam UU Nomor 13 Tahun 2003 tentang Ketenagakerjaan.
Berikut perbedaan aturan upah Undang-Undang Ketenagakerjaan (UUK) dengan Undang-Udang Cipta Kerja.
– Pasal Soal Upah
Upah satuan hasil dan waktu tidak diatur dalam UUK sebelumnya.
Dalam UU Cipta Kerja, peraturan soal upah ini ditetapkan berdasarkan satu waktu seperti harian, mingguan atau bulanan. Sementara upah satuan hasil adalah upah yang ditetapkan berdasarkan hasil dari pekerjaan yang telah disepakati.
Upah diatur di Pasal 88B yang memberikan kebebasan kepada pengusaha untuk menentukan unit keluaran yang ditugaskan kepada pekerja sebagai dasar penghitungan upah (sistem upah per satuan). Tidak ada jaminan bahwa sistem besaran upah per satuan untuk menentukan upah minimum di sektor tertentu tidak akan berakhir di bawah upah minimum.
– Upah Minimum Sektoral dan Upah Minimum Kabupaten/Kota
Dalam UUK Pasal 89, upah minimum ditetapkan di tingkat Provinsi, Kabupaten/Kotamadya, dan Sektoral. Setiap wilayah diberikan hak untuk menetapkan kebijakan Upah minimum mereka sendiri baik di tingkat provinsi dan tingkat Kabupaten/Kotamadya.
UU Cipta Kerja Omnibus Law, upah minimum diatur gubernur, tetapi dengan syarat. Pasal 88C UU Ciptaker menyatakan:
(1) Gubernur wajib menetapkan upah minimum provinsi.
(2) Gubernur dapat menetapkan upah minimum kabupaten/kota dengan syarat tertentu.
(3) Upah minimum sebagaimana dimaksud pada ayat (1) dan ayat (2) ditetapkan berdasarkan kondisi ekonomi dan ketenagakerjaan.
(4) Syarat tertentu sebagaimana dimaksud pada ayat (2) meliputi pertumbuhan ekonomi daerah dan inflasi pada kabupaten/kota yang bersangkutan.
