Gugatan Ke PT. IMSS, Penggugat Membantah Berkas Bukti Tergugat
JURNALJATENG.ID, MADIUN – Sidang gugatan perdata lanjutan, rekanan kerja terhadap anak perusahaan plat merah PT. INKA, yakni PT. IMSS, digelar kembali di Pengadilan Negeri Madiun Kota, Kamis (21/01).
Persidangan terbuka umum dipimpin hakim tunggal, Endratno Rajamai, SH, dengan Panitera, Ambo Della, SH, itu beragendakan penyerahan bukti oleh tergugat, plus mendengar keterangan saksi yang dihadirkan penggugat.
Duduk di meja tergugat, sekembali menyerahkan berkas tertulis di meja hakim, Kolik, Dirut PT. IMSS selaku tergugat, terlihat menunjuk menunjukkan jarinya ke arah hakim.
Sikapnya itu seakan dimaksudkan Kolik sebagai penekan, guna menjelaskan berkas bukti, yang belum dipahami hakim tunggal dengan menanyakannya kepada Kolik.
Menyaksikan itu, sang hakim yang mengadili gugatan sederhana, kali ke tiga tersebut, diam. Dia hanya memandang tajam ke arah Kolik, dengan tatap mata fokus beberapa jurus.
Sang hakim kemudian menegur dan menolak (sementara) permintaan Kolik (tergugat), yang minta waktu untuk bertanya kepada Sumarno, saksi yang dihadirkan Sunarto, penggugat.
“Tidak. Jangan sekarang. Nanti ada waktunya sendiri bagi saudara untuk bertanya kepada saksi,” tukas Endratno Rajamai, SH.
Menjawab pertanyaan hakim, Sumarno mengaku memang benar benar pernah bekerja, mengerjakan bermacam jenis proyek di lingkungan PT. INKA.
“Membongkar dan memasang rel kereta api, penambahan aspal jalan, pemasangan paving, pengecatan gudang, dan jenis proyek lainnya,” tutur Sumarno kepada hakim.
Sementara di luar persidangan, Sunarto (penggugat), kepada jurnalis membantah berkas bukti tergugat yang diserahkan hakim. “Yang diserahkan tergugat kepada hakim itu adalah item proyek yang sudah dibayar. Sedangkan yang saya tagih itu proyek yang belum dubayar,” bantah Sunarto.
Dulu, lanjut Sunarto, pada tanggal 14 September 2020, ketiga vendor (dirinya, Widodo dan Sugito) diajak rapat (mediasi) oleh pihak PT. IMSS di kantornya, Jalan Salak Madiun. Mediasi tersebut atas perintah Komisaris Utama PT. INKA, Dr. I Gede Pasek Suardika, yang saat itu ternyata baru mengetahui adanya kasus tersebut.
Dalam pertemuan itu, menurut Sunarto, pihak PT. IMSS mengajak para vendor untuk melakukan cek lapangan atas semua proyek yang dikerjakan para vendor. Meski akhirnya, menurut Sunarto, rencana tersebut dibatalkan sepihak oleh PT. IMSS.
“Hasil rapat waktu itu, pihak PT. IMSS Bersedia membayar semua proyek kami yang belum dibayar. Untuk proyek yang tidak ber SPK, akan dibuatkan SPK asal benar,” papar Sunarto.
Bahkan, tambah Sunarto, beberapa item proyek yang dia kerjakan dan belum dibayar sampai kini, sudah dimanfaatkan kegunaannya oleh PT. INKA.
Sementara, seperti yang sering terjadi sebelumnya, pihak PT. IMSS sulit dikonfirmasi jurnalis. Baik Dirut PT. IMSS, Kolik, maupun Humasnya, Alvi. Sehingga tidak ada konfirmasi dari pihak PT. IMSS.
Hakim tunggal, Endratno Rajamai, SH, menutup persidangan yang berlangsung tidak bertele tele itu tetap dengan pesan, agar kedua pihak bermediasi.
Sebelum palu penutup diketukkan hakim mengumumkan, akan melanjutkan persidangan pada Selasa (26/01) pekan depan.
